TERMS AND CONDITIONS OF WORK
Payment Schedule and Deposit
Deposit will be 30% of the value of the works quoted. Payment Schedule to be agreed in advance and a signed and dated copy attached to a contract if applicable. Otherwise these terms and conditions will take precedence.
High Value Items
High valve supplied items such as kitchens & bathroom suites must be paid for in full either prior to works commencing or orders being placed, whichever comes first. This sum will be invoiced separately. At our discretion other high value items, for example worktops, appliances, roof lights / glazing, windows, folding sliding doors, tiles, electrical fittings etc may also be separately invoiced in full, prior to orders being placed. Items that we supply are charged at cost plus 20%
Practical Completion
You agree that Practical Completion is the point at which works are substantially complete with all remaining tasks being minor corrective issues. If completion of a major item of works is delayed due to late delivery of a client supplied item or late completion by another contractor working directly for the client, or another third party, we will invoice for practical completion when we have completed all works unrelated to this delay.
Snagging and retention
When we state that we have reached Practical Completion we will work with you to compile and agree a final snagging list. On completion of this agreed list you will pay us the amount for snagging as agreed in the payment plan. Additional works carried out with the original contract are not included or subject to any retention agreements
Variations
Agreed variations to the original specification will be billed once this work is complete. Additional works undertaken will be detailed in a variation form sent via email or fax. We reserve the right to refuse to undertake works additional to those in the agreed specification. You agree not to instruct additional works or variations directly to the site manager or site operatives. Variations may be subject to additional preliminary (fixed) costs associated with setting up and running a safe and well managed workplace.
Payment
You will pay the deposit for works via electronic bank transfer one week before work commences on-site. Subsequent payments may be made by electronic BACS or CHAPS transfers. Invoices must be settled as cleared funds within 7 days of receipt. You understand that overdue invoices will result in works being suspended until cleared funds are received. In accordance with our statutory rights we will charge interest calculated daily at 8.5% over the Royal Bank Of Scotland base rate on overdue invoices. Please note that we cannot accept stage payments via cheque.
Client Delays
If the client delays the agreed start date less than 30 days prior to works commencing, or stops works in progress for any reason, all costs (preliminaries) associated with the day-to-day running of the site will be chargeable to you by us. This includes all costs associated with site set up and site management. We ask that any you confirm any delays to works promptly via email.
Consents and Designs
Unless we have a specified design remit, the client must confirm, and take responsibility, that all walls to be moved or new doorways made through walls are non-load bearing. We recommend that you obtain drawings or sketches for all changes, designs and layouts. Unless specifically stated otherwise, you are responsible for any necessary planning permissions, building control approvals, party and boundary wall awards, listed buildings consent and licenses of alteration.
Fees
Unless it is specifically stated otherwise in our quotation, it is assumed that all planning, building control, architects, party wall surveyors, structural engineers, independent surveyors and managing agents fees will be meet by the client.
Client Supply
All new fixtures and fittings, unless specifically stated otherwise, to be provided by the client. The price is based on all client supplied items being designed for standard UK plumbing and electrical fitting, sizes and ratings. Unless otherwise stated all tiling is assumed to be ceramic, approximately 300mm * 300mm non mosaic and of a uniform width and thickness. Supplied spotlights are assumed to be LV 50v White spots. All sockets and switches are assumed to be white from the MK logic Range.
Combination Boilers and Plumbing
The client understands and accepts that when changing from a traditional system to a combination boiler that there may be a reduction in water pressure.
Client property
We recommend that all furniture, pictures and delicate items be removed from the works area, including access areas, during the works, and those that are left are adequately protected. We cannot accept responsibility for damage and dust contamination for items left on site. We will provide protection as agreed to fixtures and fittings as far is as reasonably possible. You are advised to inform your insurance companies that building works are being undertaken to ensure adequate cover.
Quotation, copyright, site access and asbestos
The quotation is based on the drawings and detail therein, as provided by the client or architects drawings. The price is valid for 30 days. The quotation is subject to a site visit and a quantity surveyors report and / or a structural engineer’s assessment and calculations where necessary. Timescales are estimated and dependent on material and labour availability. The quotation is based on the assumption that there are no limitations on our use of the site between 8 am – 6pm Monday to Friday & 8am to 1pm on Saturday. Where clients, their managing agents or another third party have stipulations limiting our work or access during this period, or do not allow materials or rubbish to be removed from the site using common areas it is the client’s obligation to inform us of these rules prior to the quotation being accepted. Such limitations will result in a change to our pricing. For pricing purposes it is assumed that there is no asbestos in the property.
Dispute
In the instance of any dispute the client is obliged to accept independent arbitration via FMB, RICS, RIBA or another agreed third party, and the findings of such arbitration. Where another agreement such as a JCT or FMB standard building contract are in place, our terms & conditions take precedence.
Agreement
You accept that payment of the deposit signifies your agreement of the contract including these Terms and Conditions.
